You should tell her that, probably in so many words. You're certainly within your rights to ask her to take it down. And I think from now on you may want to include a longer disclaimer on your pieces, specifying that they're not to be used without permission.

Date: 2007-01-16 06:27 pm (UTC)I've always realized that to place my art on the Internet is to put it out of my control, so I've been unsure how to deal with such issues. As far as the art where I reproduce a photograph, which is basically another artist's work, I'm usually willing for others to use it, provided that they give credit. And I certainly don't try to sell it! That really would be a copyright violation, and it shocks me every time I see people doing it.
So far this is the first person who hasn't asked first. And this art actually is original fanart (if that isn't an oxymoron) rather than the copy of an exact photograph. It was also a gift to

Still, it's a matter of respect to ask permission for use. You can't force her to take it down legally, but you can certainly ask her to...forcefully, if need be, and the weight of fandom social convention would be behind you. But I should think (and hope) that it shouldn't take much more than an explanation of the circumstances and your reasoning for wanting the art to remain under your control as much as possible.
Let me know if you need me to write any C&D letters... *grins*

Date: 2007-01-16 08:31 pm (UTC)I did as you suggested and simply explained my feelings on the subject. I didn't even ask her to remove the art, but she wrote back saying she had done so, so it was definitely just a case of inadvertant thoughtlessness. Next time, I imagine she'll ask.
So no need for the C&D letters :D
But thanks again for the pro bono service. Let me know when you get your license, and I'll put you on retainer to harry any art pickpockets that come my way!
